Now Hallam Estates has landed in the courts twice in recent years and if you type these citation – [2014] EWCA Civ 661 & [2012] EWHC 1046 (QB) – into Google the cases will come up and you can have a good read.
A case against Mr Stainer for non payment of Tax NI etc to his full time employees has been made by HMRC and the Grand raided by HMRC in July 2015 and 3 people were arrested, Mr Stainer and Mrs Stainer being two of the three. However on the 25 Feb 2016 Justice Short in the First Tier Tax Tribunal ruled in a separate case from the tax raid case that Mr Stainer cannot say that a lack of trade does not prevent Appellant from being treated as an employer – carelessness accepted – penalties increased
So Mr Stainer in this case lost and has 56 days to appeal. Now for a man who has no money to pay his employees taxes he sure seems to have enough to pay lawyers, perhaps it might be a good time for Mr Stainer to focus on the important things, that being paying his staff taxes as other companies have to.
