On Valentine’s Day we published the blog post:

In short it was about Creative Folkestone (CF) increasing rents but not following the correct procedure. In the blog we mentioned Form 4 must be used to increase the rent if the Assured Shorthold Tenancy (AST) agreement doesn’t have a rent increase clause inserted into it. The Form 4 must be served on the tenant.

CF Tenants ASTs we saw did not have a rent increase clauses in their agreement, meaning CF had to issue Form 4

Once Form 4 is filled in by the landlord stating the rent will increase, it must be served on the tenant, no if or buts.

However, CF tenants have shown us emails from the “Creative Quarter Manager” which state:

We’re issuing the Landlord’s notice proposing a new rent form [Form 4] when requested by tenants…”

We are not sure if CF have got a handle on this situation. So for anyone reading this who is employed by CF, we’ll spell this out clearly we hope.

CF as the landlord MUST serve the proscribed Form 4 on the tenant. That is CF Must send it to them via post or email, or better still both. Tenants do not need to request Form 4 which tells them about their rent increase. If they don’t receive Form 4, then the process is not lawful and if the tenant does not pay the new increase there is little to nothing the landlord can do, as the tenant didn’t receive Form 4. Now we hope and we pray that someone in the Creative Folkestone Organisation understands the above.

Moving on we note CF have decided not to recognize the Creative Folkestone Residential Tenants Association (CFRTA). This is because at this time CFRTA does not currently have a constitution and CF would prefer to deal with each individual tenant.

Finally, on Valentine’s Day we noted that some of the Energy Performance Certificate for some of the CF properties at CT20 1RN had expired. Since we mentioned this, CF have updated the EPCs  for CT20 1RN.
