Now Michael Stainer is safely ensconced in one of Her Majesty’s Prison’s, as he was found guilty of two counts of cheating the public revenue and one of fraud by false representation, and sentenced to three years, one would have thought the shenanigans at The Grand would have stopped, but alas they have not.
The former employees of The Grand have sought to use there rights to ensure the get paid what they were owed via the redundancy route, going to ACAS and then onto the employment Tribunal to wind up Seaside Hosts Ltd and Folkestone Capital Limited.
Post has been sent to The Grand from the Employment Tribunal to the Director of the companies, Robert Graham Moss aka Victor Klinkenhoffer (pictured).
The Grand’s residents board is aware of Mr Moss’s address in the Lyminge area, but rather than forwarding the post onto him, which would have been the decent thing to do, we can reveal the post was opened and the contents read.
A person commits an offence if, without reasonable excuse, he—
(a)intentionally delays or opens a postal packet in the course of its transmission by post, or (b)intentionally opens a mail-bag.
(2)Subsections (2) to (5) of section 83 apply to subsection (1) above as they apply to subsection (1) of that section.
(3)A person commits an offence if, intending to act to a person’s detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him.
(4)Subsections (2) and (3) of section 83 (so far as they relate to the opening of postal packets) apply to subsection (3) above as they apply to subsection (1) of that section.
(5)A person who commits an offence under subsection (1) or (3) shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale or to imprisonment for a term not exceeding six months or to both.
Now we very much doubt the person who did this are going to hand themselves into the local police station.
It is an offence for a person knowingly or recklessly—
(a)to obtain or disclose personal data without the consent of the controller,
(b)to procure the disclosure of personal data to another person without the consent of the controller, or
(c)after obtaining personal data, to retain it without the consent of the person who was the controller in relation to the personal data when it was obtained.
Again, we do not suspect the person responsible will be admitting the truth anytime soon, to the appropriate authorities, or the persons named in the documents.
Just because Michael Stainer is behind bars, and Victor Klinkenhoffer – aka Robert Moss – is being taken to court by some of the former employees of The Grand, to rightfully get the monies they are duly owed, does not give anyone the right to break the law and interfere with Robert Moss’s post, or Data Protection rights.
The very fact there has been interference in court communications by a third party, makes one wonder what other mischief they, may or may not have got up to. It most certainly dents there credibility.
We doubt the person involved will do the right thing and own up to their wrongdoing. Breaking the law to obtain information you are not entitled to, goes to show that even after Stainer is behind bars, the law continues to be broken at The Grand.
Why cant whoever is doing these things STOP, let us just get what we are due and let us move on .We are all in limbo , this has been 2 years of our lives .We are all trying to do the right thing legally and just get closure to a nightmare of a situation. .Whoever is doing all this should hang their heads in shame .We did abdolutely nothing wrong when we worked at The Grand , it wasnt us that was battling with the residents .We kept the place alive and ticking along.(not like it is now ,an empty crumbling mess ) .Please just do the right thing forward the post on or return it to the sender

Foolish to succumb to temptation in this way, but small beer compared to the antics of Stainer and Moss.
